Terms & Conditions for Revplus

  1. Acceptance of Terms
    By accessing or using the website https://revplus.tech/ (the “Platform”), which is branded as Revplus and owned and operated by JM Official, you agree to be bound by these Terms and Conditions (“Terms”). If you don’t agree to these Terms, you shouldn’t use or access the Platform.
  2. Services
    Revplus provides a purely digital software platform that offers revenue intelligence and sales tools specifically for sales & marketing teams. This includes access to various features and functionalities, such as data analytics dashboards, communication tools, message/email template creation, and video recording storage. The Platform is a DIY (Do-It-Yourself) service; you’re responsible for the direct management and operation of your account and how you use the Platform’s features and settings.
  3. User Accounts
    To access the Platform, you’ll need to register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated. You’re responsible for safeguarding your password and for all activities that happen under your account. Please notify us immediately of any unauthorized use. We can’t and won’t be liable for any loss or damage from your failure to keep your account secure. You must be at least 18 years old to create an account and use the Platform.
  4. Payments and Billing
    The Platform is a paid service offered on a monthly subscription basis. All fees are quoted in INR (Indian Rupees). You agree to pay all applicable fees and taxes associated with your use of the Platform. You authorize Revplus (operated by JM Official) to charge your chosen payment method for the monthly subscription fee. Refunds are governed by the applicable laws of India.
  5. User Content
    You can create and upload various content to the Platform, including message templates, email templates, video recordings, and other materials needed for the Platform’s operation. You retain ownership of this content. However, by uploading or posting content, you grant Revplus (operated by JM Official) a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that content solely to operate the Platform. This license is essential for us to provide the services. You confirm that you own or have the necessary rights to grant us this license and that your content doesn’t violate any third-party rights, including intellectual property rights. You are solely responsible for the content you create and upload. Revplus (operated by JM Official) has no control over and isn’t responsible for user-generated content.
  6. User Conduct and Responsibilities
    You agree to use the Platform only for lawful purposes and in a way that doesn’t infringe on anyone else’s rights or restrict their use of the Platform. You agree not to:
    • Post or transmit any content that’s obscene, offensive, libelous, defamatory, pornographic, abusive, or violates others’ intellectual property rights.
    • Use the Platform for any purpose that breaks any applicable law or regulation.
    • Post or transmit “spam” or unsolicited content.
    • Try to gain unauthorized access to any part of the Platform, or any systems or networks connected to it or to any Revplus (operated by JM Official) server.
    • Interfere with or disrupt any user’s access or the Platform’s operation.
    • Upload or transmit viruses or any other malicious code.
    • Use the platform to engage in unlawful activities.
  7. Platform Actions and Social Media Integration
    The Platform may connect to and interact with various social media platforms. You understand and agree that:
    • The Platform may perform actions on your behalf on these social media platforms, like sending invites or messages, as allowed by those platforms’ terms of service.
    • You are solely responsible for complying with the terms of service of any social media platforms you connect to the Platform.
    • Revplus (operated by JM Official) isn’t responsible for any actions taken by social media platforms in response to the Platform’s activities.
  8. Disclaimers and Limitation of Liability
    No Guarantees: Revplus (operated by JM Official) provides a DIY platform and has no control over how you use it. We don’t guarantee specific outcomes or results from using the Platform. While we aim to provide a functional and effective platform, we don’t warrant that it will meet your specific needs or be uninterrupted, timely, secure, or error-free.

    The Platform and its services are provided “as is” and “as available,” without any warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

    To the fullest extent permitted by law, Revplus (operated by JM Official) won’t be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses. This includes damages resulting from: (i) your access to or use of, or inability to access or use, the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we’ve been informed of the possibility of such damage.
  9. Indemnification
    You agree to defend, indemnify, and hold harmless Revplus (operated by JM Official), its affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Platform, including your User Contributions, and any use of the Platform’s content, services, and products not expressly authorized in these Terms.
  10. Links to Third-Party Websites
    The Platform may contain links to third-party websites or resources. These links are for your convenience only. We have no control over the content of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any third-party websites linked to this Platform, you do so entirely at your own risk and subject to their terms and conditions.
  11. Termination and Suspension
    We may terminate or suspend your account and prevent access to the Platform immediately, without prior notice or liability, if you engage in any unlawful activities or if legally required by law. We may also terminate or suspend your account for any other reason at our sole discretion. Upon termination, your right to use the Platform will immediately stop. If you want to terminate your account, you can simply stop using the Platform. All provisions of the Terms that, by their nature, should survive termination will survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
  12. Governing Law and Dispute Resolution
    These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

    Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be referred to and finally resolved by binding arbitration in Bengaluru, Karnataka, India, in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended. The language of the arbitration shall be English. The decision of the arbitrator(s) shall be final and binding on both parties.
  13. Changes to Terms
    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a change is material, we’ll provide at least [e.g., 30 days’] notice before the new terms take effect. What constitutes a material change is up to our sole discretion. By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms. If you don’t agree to the new terms, you’re no longer authorized to use the Platform.
  14. Severability
    If any part of these Terms is found to be invalid or unenforceable by a court, the remaining parts of these Terms will remain in effect.
  15. Entire Agreement
    These Terms represent the entire agreement between us regarding our Platform and replace any prior agreements we might have had.
